1. Miscellaneous provisions
The following terms and conditions and any other related rules introduced by Fondation Cartier which are notified to customers in accordance herewith (referred to hereinafter together as the “General Terms & Conditions of Sale”) will apply to all products which you (hereinafter either the “Customer” or “you”) may order from SNC Cartier & Cie, a French société en nom collectif registered with the Trade and Companies Register of Paris under number B331 876 284 which has its registered office at 261 boulevard Raspail, 75014 Paris (referred to hereinafter as either “Fondation Cartier” or by the words “we”, “us” or “ours”) through the online ticketing service of Fondation Cartier having the domain name http://fondation.cartier.tickeasy.com (the “Website”)
These General Terms & Conditions of Sale will apply exclusively to sales completed on the Website. Fondation Cartier reserves the right to amend the General Terms & Conditions of Sale at any time. Accordingly we invite you to carry out regular checks in order to be kept informed of any updates. Any updated version of these General Terms & Conditions of Sale will take effect immediately on the date of its publication and will be applicable to all orders of products with effect from such date.
The General Terms & Conditions of Sale applicable to any order made on the Website will be those in force when you order on the Website. By clicking on the “I accept” checkbox or any similar checkbox appearing on the order confirmation page prior to submitting your order to Fondation Cartier, you will accept these General Terms & Conditions of Sale without reservation. Should you decline to accept these General Terms & Conditions of Sale, you will be unable to order any product from the Website of Fondation Cartier.
Persons wishing to use the Website will also be deemed by the fact of such use to have agreed to be bound by our Terms of Use of our Website and our Privacy Policy.
2. Terms of purchase
Only persons who (a) have attained the age of majority (which is 18 years of age in most countries) and (b) have legal capacity to contract may order products from the Website. If you have not attained the age of majority or if for any other reason you do not have legal capacity to contract, a parent or guardian may submit an order on your behalf and accept thereby these General Terms & Conditions of Sale. Any order submitted in breach of this provision will be deemed null and void.
By ordering on the Website you represent and warrant that you are a customer and end user acting in good faith making a purchase for your own use or the personal use of a third person. Fondation Cartier may reject your order should it have valid reason to believe your order is made in breach of these General Terms & Conditions of Sale or on any other legitimate ground.
3. Creation of a customer account, personal information and payment in guest mode
To submit an order on the Website, you must create an online customer account. In order to create a customer account, you must provide valid and up-to-date personal information, including your first name(s) and family name, telephone number and e-mail address, and you must confirm that you are at least 18 years of age.
When you have created a customer account on the Website, you will receive an e-mail which will enable you to access your customer account on the Website and to generate a permanent log-in name and password for your customer account. You may also receive a second e-mail summarising the personal information provided during the creation of your online customer account. It will be your responsibility to ensure at all times that your password remains confidential and secure and that access to your customer account is secure. Fondation Cartier will not be liable for any fraudulent use of your customer account if accessed by a third party using the log-in name and password for your customer account.
We may from time to time modify the information required to submit any further orders or to create a customer account. Any such modifications will be published on the Website. Please consult our Privacy Policy and Section 8 “Payment” of these General Terms & Conditions of Sale, in which you will find full details of the uses to which we may put your personal information. In accordance with Article L.223-2 of the French Consumer Code, we hereby inform you that you may include your name on the “Bloctel” list in order to avoid receiving unsolicited marketing calls. Fondation Cartier does not engage in this practice. For more information please consult our Privacy Policy.
In the event of any change to the information provided by you on the Website, please log into your customer account and update such information directly on the Website. In addition, should Fondation Cartier have any reason to suspect that a third party has breached a Customer’s
registration or account password and/or log-in name, Fondation Cartier will immediately cancel and shut down such customer account and inform you thereof by e-mail or telephone.
4. Orders
If you wish to make an order on the Website, your order will be processed as follows:
- The Customer must select the date and time of their visit (where applicable) and the number of tickets required in each price category, subject to ticket availability. When submitting an order, the Customer will be kept informed in real time of the availability of the TICKETS requested.
- The Customer must create a customer account by inputting an e-mail address and password or the log-in details for an existing customer account, as the case may be. The creation of a customer account will require that information which is necessary and mandatory to process any future orders be provided: first name(s) and family name, telephone number and e-mail address.
- An order summary will be displayed. After checking their order and personal information (in particular the e-mail address provided) and confirming that they have familiarised themselves with these General Terms & Conditions of Sale, the Customer will then pay for their order online by providing their card details (card number, expiry date and security code) on a secure payment platform.
- If the relevant payment platform refuses payment, the order will be automatically cancelled. Payment for the order by the Customer will constitute irrevocable acceptance of the order, which may not be cancelled or modified.
- TICKETS ordered on this website may be printed (please see the terms of printing below) immediately after receipt of payment. The Customer is responsible for ensuring that the contact details provided during purchase are correct.
5. Issue of TICKETS
No print-off of the order confirmation page or purchase confirmation e-mail sent by Fondation Cartier to the Customer will constitute a TICKET. Such a document may in no circumstances serve as a TICKET granting access to Fondation Cartier.
Print-at home TICKETS will be available in a PDF format as soon as the purchase is approved and may be printed by the Customer up to and including the date of their visit by opening the PDF file attached to the purchase confirmation e-mail or downloaded from the customer account of the Customer, which may be accessed from the Website. In order to be valid, a TICKET must have been printed once only on white A4 paper which is blank on both sides. The Customer must print as many barcodes (“TICKETS”) as there are visitors.
TICKETS downloadable onto mobile telephones (m-tickets) will also be accepted.
Each TICKET will feature a barcode granting access to Fondation Cartier.
Printed TICKETS must be of good print quality. Partially printed, soiled, damaged or illegible TICKETS will not be accepted and will be deemed invalid. In order to verify that their ticket is of acceptable print quality, the Customer must ensure that both the information on the TICKET and the barcode are legible.
The Customer must prior to each order ensure that they have the equipment and software necessary to print off their TICKETS, namely a computer granting access to the internet plus a printer and the appropriate software. TICKETS may be displayed in PDF format on a smart phone or tablet.
There will be no equipment available to the Customer on site on the date of their visit enabling them to print their TICKET. The Customer must therefore arrive with a pre-printed TICKET.
In the event of the loss, theft or duplication of a TICKET, only the first person to present such TICKET will be deemed the legitimate holder of the TICKET and granted access to Fondation Cartier.
Fondation Cartier will have no liability whatsoever in the event of the loss or theft of a TICKET.
6. Prices, tax and rental costs
Unless provided otherwise, all the prices displayed on the product pages of the Website will be in Euros and will include VAT. Please note that the VAT applicable is French VAT, irrespective of the place of purchase of a product.
Fondation Cartier reserves the right to modify prices at any time and without notice. The product price displayed on the Website when Fondation Cartier issues you with an Order Confirmation will be honoured by Fondation Cartier.
7. Verification and confirmation by the Customer
We recommend that you carefully verify all the details of any order prior to confirming it on the Website, including but not limited to the information specific to each sale provided on the Website.
After verifying you order in full, please first of all click on the checkbox appearing to the left of the words “I have read and accepted the general terms & conditions of sale”, in order to denote your acceptance of these General Terms & Conditions of Sale, and then please click on the checkbox “Confirm and pay for order” (on the Website), in order to submit your order.
By submitting an order you are making an offer to Fondation Cartier to purchase the products placed in your “Shopping bag”. Notwithstanding any contrary provision herein, Fondation Cartier reserves the right to reject, cancel or terminate any order at any time should it have a legitimate reason for doing so.
8. Payment
8.1. Payment methods
You may pay for your order using a credit card or debit card, as stated on the Website.
When ordering on the Website, you must input your payment details on the appropriate form. Please consult our Privacy Policy, where you will find detailed information on how and for how long we may use or retain your personal information.
All holders of credit cards/payment cards will be subject to validation checks and card issuer authorisation procedures. If your card issuer refuses to authorise payment to Fondation Cartier, you must contact your issuer directly in order to resolve the issue, and Fondation Cartier will not be liable for any delayed delivery or non-delivery.
In order to process your order, we may seek prior authorisation for your payment card. The amount of your purchase will be blocked on your payment card until the despatch of your order to the e-mail address provided to Fondation Cartier. An Order Confirmation will then be sent to you and the purchase price debited from your payment card. By submitting an offer to purchase products from the Website, you expressly authorise Fondation Cartier to seek prior authorisation for your payment card and, should Fondation Cartier deem this necessary, to communicate or obtain information (including updated information) related to you to or from third parties, including but not limited to the number of your payment card, for the purposes of the authentication of your identity, the validation of your payment card, the grant of preliminary authorisation for your payment card and the authorisation of individual purchases. Please refer to our Privacy Policy, where you will find detailed information on how and for how long we may use or retain your personal information.
In accordance with these General Terms & Conditions of Sale, the processing of payments for products purchased on the Website by credit card or payment card will be undertaken by SNC Cartier & Cie, a société en nom collectif registered with the Trade and Companies Register of Paris under number B331 876 284, which has its registered office at 261 boulevard Raspail, 75014 Paris.
8.2. Security
For each payment made for an order of TICKET(s) on the Website Fondation Cartier will use the services of PAYZEN, which operates a secure online payment system making it possible to encrypt the bank card number of the Customer.
The PAYZEN secure payment solution uses the TLS protocol (which encrypts all information associated with the card) and which holds numerous certifications (PCI DSS, CB Cartes Bancaires, Visa Merchant agent certification). The bank details of the Customer are therefore protected, as only the payment approval codes issued by banks are retained.
Fondation Cartier warrants that the encryption methods and services used to ensure the security of transactions have been authorised or declared in accordance with the legislation in force.
9. Acknowledgement of receipt of orders
Once you have submitted your order on the Website, you will receive by e-mail an “Acknowledgement of Receipt of Order” setting out the details of your order, together with these General Terms & Conditions of Sale. The Acknowledgement of Receipt of Order will contain a reference number allocated by Fondation Cartier. Please consult the General Terms & Conditions of Sale on receipt and please retain the order reference number to be quoted in the event of any future queries regarding your order.
The Acknowledgement of Receipt of Order does not constitute acceptance of your order. Following the despatch of the Acknowledgement of Receipt of Order, Fondation Cartier will proceed with its standard security checks and then process your order.
10. Confirmation of orders by Fondation Cartier
The “Order Confirmation” constitutes acceptance of your order by Fondation Cartier, denoting the existence of a binding contract for sale.
Fondation Cartier will retain information on all orders in accordance with the requirements imposed by the applicable legislation. Customers may be granted access to such documents after logging in on the “My account” page of the Website.
You will receive an e-mail confirming payment for the order from the payment centre. The Customer will then receive an e-mail from the Website confirming their order.
Order Confirmation e-mails contain the following information:
- the essential features of the TICKET(s) sold (place, date and time of visit);
- a unique transaction number; and
- the total amount of the order.
11. Invoices
When ordering products from the Website, you as Customer will have the option of electing to receive an invoice at their billing address. If you decide at such time that you do not wish to receive an invoice, you may then and at any time thereafter consult your invoice by logging into “My account” using your log-in details.
12 - Ticket refunds and exchanges
In accordance with paragraph 2 of Article L.121-20-4 of the French Consumer Code, the Customer will not have the 14-day withdrawal period provided for by Article L.121-18 of the same Code.
No TICKET which is purchased may be returned or refunded, even in the event of its loss or theft or forgetting.
Due to any safety requirements which may be notified to it, Fondation Cartier reserves the right to close its premises or to modify its opening hours.
In the event of the cancellation of the event to which the TICKET grants access, Fondation Cartier will contact the Customer as soon as practicable by e-mail, in order to inform them of such cancellation and to propose either:
- (where possible) attendance with the same TICKET at a later date and time; or
- a refund of the relevant TICKET, in which case it will specify the applicable terms and conditions.
13. Final provisions
13.1 Information and complaints

13.2 Whole agreement
The General Terms & Conditions of Sale, including the Terms of Use of our Website and our Privacy Policy, constitute the whole agreement between you and Fondation Cartier with regard to your purchase of products from the Website and cancels all previous general terms & conditions of sale.
13.3 Severability
Should any provision of these General Terms & Conditions of Sale be deemed partially invalid or inapplicable by a court for any reason whatsoever, such provision will be invalid or inapplicable only to the extent of such ruling, and the validity and applicability of the other provisions of the General Terms & Conditions of Sale will not be affected thereby.
14. Governing law
These General Terms & Conditions of Sale are governed by and will be interpreted in accordance with French law, without reference to conflict of laws provision and to the exclusion of the Vienna Convention.
15. Competent courts
You may bring proceedings against Fondation Cartier before either the French courts or the courts in your country of domicile. SNC Cartier & Cie may also bring an action against you before the courts in your country of domicile.
Without this provision restricting the right to instigate legal proceedings before a court, Fondation Cartier or the Customer will do their utmost for a period of thirty (30) days to settle amicably any dispute or disagreement which may arise from or in connection with the product or these General Terms & Conditions of Sale or any breach hereof.
If you are a consumer resident in the European Union, you may submit your complaint to an Alternative Dispute Resolution body. For a list of ADR bodies in your country, please consult the Online Dispute Resolution platform of the European Commission at http://ec.europa.eu/consumers/odr.
In accordance with Article L.612-1 of the French Consumer Code, you may also use free of charge the services of the Association des Médiateurs Européens under whose jurisdiction we fall, either online at https://www.mediationconso-ame.com, by filling in the dedicated form and attaching documents substantiating your request or by sending a letter to AME Conso at 11 place Dauphine, 75001 PARIS
